1. About Us

These terms and conditions apply to First Choice Energy Ltd and to all services provided through our websites.

SoulourPower (soulourpower.energy) and CavityTherm UK (cavitythermuk.co.uk) are trading names of First Choice Energy Ltd. These terms apply to all services provided under all three brands.

2. Services

First Choice Energy Ltd provides domestic and commercial energy efficiency services, including:

  • Solar photovoltaic (PV) systems and battery storage
  • Air source heat pumps (domestic and commercial)
  • Gas boiler installations
  • Loft insulation, cavity wall insulation, internal wall insulation and room in roof insulation
  • Cavity wall extraction
  • Mechanical and background ventilation

Coverage varies by service. Solar PV and all commercial services are available UK wide. All other domestic services are currently available in South Wales and South West and West England. Please contact us to confirm coverage for your property.

All services are subject to a free, no-obligation survey and formal quotation before any work commences. We reserve the right to decline to carry out work where a property is assessed as unsuitable following a survey, for technical, safety or commercial reasons.

3. Quotations

All quotations provided by First Choice Energy Ltd are free of charge and carry no obligation on your part.

Quotations are valid for 30 days from the date of issue, unless otherwise stated in writing. After this period, prices may be subject to change.

Prices are based on information gathered during the survey. If site conditions differ materially from those assessed, we may need to revise the quotation before work begins. We will always inform you of any changes before proceeding.

VAT is included in all quoted prices where applicable unless otherwise stated.

Indicative price ranges shown on our website are for guidance only. Your final price will be confirmed in your written quotation following a survey.

4. Acceptance and Contract

A legally binding contract between you and First Choice Energy Ltd is formed when:

  1. You accept a written quotation in writing (including by email or signed quotation document), and
  2. We confirm acceptance of your order in writing

Submitting an enquiry form on any of our websites does not constitute acceptance of a quotation or create a binding contract. It is an expression of interest only.

These terms and conditions form part of every contract entered into with First Choice Energy Ltd. By accepting a quotation, you agree to be bound by them.

5. Payment

Payment terms are as stated on your individual quotation. Our standard terms are a deposit on acceptance of the quotation, with the balance due on completion of the work, unless otherwise agreed in writing.

Finance options

Finance options are available on qualifying installations, subject to status and credit approval. Finance is provided through third-party finance partners, not directly by First Choice Energy Ltd. The terms of any finance agreement are between you and the finance provider.

Late payment

Invoices not paid by the due date may accrue interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998. We will always try to resolve payment issues directly before taking any further action.

6. Cancellation

Your right to cancel

If you are a domestic consumer, you have a statutory right to cancel your contract within 14 days of entering into it, without giving any reason. This is your cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Early commencement of work

If you request that work begins before the 14-day cooling-off period has expired, and you subsequently cancel, you may be charged for the reasonable costs of any work already carried out up to the point of cancellation.

Cancellation after the cooling-off period

Cancellations after the 14-day cooling-off period may incur costs, particularly where materials have been ordered or preparation work has been carried out. We will discuss any applicable charges with you before confirming a late cancellation.

7. Workmanship and Guarantees

All work carried out by First Choice Energy Ltd is performed to the relevant British Standards, building regulations and industry codes of practice in force at the time of installation.

  • MCS-certified installations (solar PV and heat pumps) are covered by the MCS guarantee scheme, providing additional consumer protection.
  • Gas Safe work is certified on completion and registered with the Gas Safe Register.
  • Workmanship guarantee: defects in our workmanship reported within 12 months of completion will be investigated and, if attributable to us, rectified at no charge.
  • Product warranties are as provided by the relevant manufacturer and are separate from our workmanship guarantee. We will assist you in registering product warranties where applicable.

Our guarantees do not cover damage caused by misuse, accidental damage, third-party interference, or normal wear and tear.

8. Liability

Our total liability to you in connection with any contract is limited to the total value of that contract, except as set out below.

We are not liable for:

  • Indirect or consequential losses, including loss of profits, loss of savings, or loss of business opportunity
  • Losses arising from circumstances outside our reasonable control
  • Losses arising from inaccurate or incomplete information provided by you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited by law.

First Choice Energy Ltd holds full public liability insurance. Details are available on request.

9. Complaints

We take complaints seriously. If something has not gone as it should, please contact us as a first step:

We aim to acknowledge complaints within 2 working days and to provide a full response within 14 working days.

If your complaint relates to an MCS-certified installation, the MCS complaints procedure is available via mcscertified.com.

If your complaint relates to a renewable energy installation and you remain dissatisfied after our internal process, the Renewable Energy Consumer Code (RECC) consumer code applies. Details are available at recc.org.uk.

10. Governing Law

These terms and conditions, and any contract formed between you and First Choice Energy Ltd, are governed by the laws of England and Wales.

Any dispute arising from these terms or from any contract with us is subject to the non-exclusive jurisdiction of the courts of England and Wales. This does not affect any statutory rights you may have under the law of another jurisdiction.

11. Changes to These Terms

We reserve the right to update these terms and conditions at any time. The version that applies to your contract is the version in force on the date your contract was formed.

For your protection, we recommend reviewing these terms before accepting any quotation. The "last updated" date at the top of this page reflects the most recent revision.
